1. Introduction and Operator Information

These Terms of Service ("Terms") govern your access to and use of the online classifieds platform CHOPPERS24.COM ("Platform"), operated by:

By accessing or using the Platform, you agree to be bound by these Terms. Access to and use of the Platform is conditional upon the full and unreserved acceptance of these Terms.

2. Scope of Services

CHOPPERS24.COM is an online classifieds marketplace that allows registered users to post and browse advertisements for real estate, vehicles, vehicle parts, jobs, and general products across Estonia, Latvia, and Lithuania. The Platform acts solely as an intermediary and is not a party to any transaction between buyers and sellers.

3. User Eligibility and Registration

To post listings, you must:

Be at least 18 years of age or have parental/guardian consent;
Provide accurate and truthful registration information;
Maintain the confidentiality of your account credentials;
Comply with all applicable local, national, and EU laws and regulations.

Legal entities may register and use the Platform for commercial purposes, subject to these Terms.

4. Listing Rules and Prohibited Content

Users must not post listings that:

Involve illegal goods or services under Estonian law, EU law, or the law of the buyer's or seller's jurisdiction;
Contain false, misleading, or deceptive information;
Infringe intellectual property rights of third parties;
Constitute spam, duplicates, or off-topic advertisements;
Violate consumer protection laws, including Directive 2011/83/EU;
Include personal data of third parties without their consent (GDPR Art. 6);
Promote discrimination, hate speech, or violence;
Advertise weapons, controlled substances, or restricted items without proper authorization.

CHOPPERS OÜ reserves the right to remove any listing that violates these rules without prior notice and to suspend or permanently ban the offending user.

5. Premium Services and Payments

The Platform offers optional paid premium features for individual listings, including color highlighting, bumping to the top of search results, and featured placement. These services are subject to the following:

Prices are stated in euros (EUR) and include applicable VAT where required;
Payments are processed securely. CHOPPERS OÜ does not store full card details;
Premium features are activated for 30 calendar days from the date of payment;
Pursuant to Article 16(a) of Directive 2011/83/EU, the right of withdrawal does not apply to digital content or services that have been fully performed with the consumer's prior express consent;
Refunds may be requested within 14 days if the service was not delivered as described, by contacting support@choppers24.com.

6. Intellectual Property

All content on the Platform created by CHOPPERS OÜ - including but not limited to logos, design, software, and text - is the exclusive property of CHOPPERS OÜ and is protected under Estonian and EU intellectual property law. Users retain ownership of the content they post but grant CHOPPERS OÜ a non-exclusive, royalty-free licence to display and distribute that content for the operation of the Platform.

7. Limitation of Liability

CHOPPERS OÜ acts as a hosting provider under Article 14 of the EU E-Commerce Directive (2000/31/EC) and is not responsible for the content of user listings. The Platform is provided "as is." CHOPPERS OÜ does not guarantee:

The accuracy, completeness, or legality of any listing;
The performance, availability, or fitness for purpose of the Platform;
The outcome of any transaction between users.

To the maximum extent permitted by applicable law, CHOPPERS OÜ's total liability to any user is limited to the amount paid by that user to CHOPPERS OÜ in the 30 days preceding the claim.

Full responsibility of the advertiser. Responsibility for everything offered, sold, requested or otherwise advertised on CHOPPERS24.COM - including the accuracy, legality, quality, condition, description, safety and pricing of every listing, product, service, vehicle, property or job posting - lies one hundred per cent (100%) with the seller, advertiser or service provider who published it. CHOPPERS OÜ, CHOPPERS24.COM and all of its subdomains hold no responsibility whatsoever for the standard, quality, suitability or pricing of any product or service sold, offered or purchased by third parties, individuals or groups using the Platform, and cannot be held liable for the content of any listing at any time, under any circumstances, to the fullest extent permitted by applicable law.

7a. Third-Party Liability Disclaimer

CHOPPERS24.COM operates solely as an online marketplace intermediary. By registering on the Platform - whether as a buyer, seller, or service provider - you explicitly acknowledge and agree to the following:

Registration and continued use of the Platform constitutes your full acceptance of these Terms, including this liability disclaimer. This acceptance occurs automatically upon account creation, prior to any listing, purchase, or contractual engagement with a third party.
CHOPPERS24.COM is not a party to any transaction, agreement, or contract entered into between users (buyers and sellers) on this Platform. All transactions are conducted exclusively between the respective buyer and seller.
CHOPPERS24.COM does not accept any liability for harm, loss, damage, injury, or financial loss suffered by any user as a result of products, services, or conduct of third-party sellers, buyers, or other users on the Platform.
Any company, merchant, or private individual selling products or services via this Platform is solely and exclusively responsible for the safety, quality, legality, fitness for purpose, and accuracy of the products and services they offer.
CHOPPERS24.COM does not verify, endorse, or guarantee the quality, safety, pricing, or compliance of any product or service listed by third parties. Any reliance on listings is at your own risk.
In the event of any dispute, defect, non-delivery, or other issue arising from a third-party transaction, the buyer must contact the seller directly. CHOPPERS24.COM will not be held liable and is under no obligation to mediate, compensate, or resolve such disputes.

By creating an account and using this Platform, you irrevocably accept these terms and waive any claims against CHOPPERS OÜ arising from third-party conduct or third-party products and services.

8. Data Protection

The processing of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. CHOPPERS OÜ complies with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Estonian Personal Data Protection Act (isikuandmete kaitse seadus).

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Estonia. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of Harju County Court (Harju Maakohus), Tallinn, Estonia, unless mandatory consumer protection laws of the user's country of residence require otherwise.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

10. Changes to These Terms

CHOPPERS OÜ may update these Terms at any time. Material changes will be communicated to registered users at least 30 days before taking effect, by email or platform notification. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

12. Prize Draws - Terms and Conditions

CHOPPERS OÜ (hereinafter 'the Organiser') runs a recurring cash prize draw on the CHOPPERS24.COM platform. By publishing a listing you automatically enter the draw and agree to the following terms:

Prize: 25,000 EUR in tax-free cash per draw, paid by bank transfer to an account in the winner's name. No alternative prize is offered and the prize is non-transferable.
How to enter: every listing published on CHOPPERS24.COM during the relevant draw period counts as one (1) entry ticket. There is no upper limit - if you publish 15 listings, you receive 15 entry tickets.
Eligibility: open to natural persons aged 18 or over who hold a registered account on CHOPPERS24.COM. Employees of CHOPPERS OÜ and their immediate family members are excluded.
Draw and live stream: the draw takes place within the first seven (7) days after the end of each draw period and is streamed live on the official CHOPPERS24 Facebook and Instagram channels. All draw dates are notified to all members in advance, free of charge. Winners are selected by a verifiably random method from all eligible entries of that draw period.
Notification: the winner is notified by email to the address registered on their CHOPPERS24.COM account within 7 calendar days of the draw and must confirm acceptance within 30 calendar days. Failure to respond results in forfeiture and a replacement winner may be drawn.
Taxes and duties: the prize is paid out by the Organiser without deduction; any income tax or other charge arising in the winner's country of residence is the sole responsibility of the winner.
Data processing: personal data of participants is processed by CHOPPERS OÜ solely to administer the draw, in accordance with GDPR and the Privacy Policy. The winner's first name and country of residence may be published on the platform and announced during the live stream.
Modification and cancellation: CHOPPERS OÜ reserves the right to cancel, suspend or modify any draw at any time due to circumstances beyond its control, including technical failures, fraud or force majeure, without liability to participants.

Participation in the draw constitutes acceptance of these terms. This promotion is governed by the laws of the Republic of Estonia. Any disputes shall be resolved in accordance with Section 9 of these Terms.

IMPORTANT NOTICE: Images used in promotional materials are illustrative only. The cash prize consists exclusively of 25,000 EUR in cash - no apartment, vehicle or other physical prize forms part of this draw. The separate monthly smartphone draw is described in Section 14.

13. Financing Calculator - Disclaimer

The financing calculator displayed on vehicle and real-estate listings is provided for illustrative and informational purposes only. All figures, monthly instalments, interest rates (APR), down-payment values and totals are simulated estimates.

The calculator does not constitute a binding offer, credit approval, pre-approval, contractual commitment, or any form of financial advice.
No credit assessment, affordability check or verification of any kind has been performed.
CHOPPERS OÜ is not a licensed credit institution, lender, credit broker or financial intermediary and does not itself provide, arrange or underwrite any financing.
Actual loan terms, interest rates, fees and eligibility are determined solely by third-party partner banks and lenders and may differ significantly from the values shown.
Users must obtain a formal offer directly from a licensed lender before entering into any credit agreement.

CHOPPERS OÜ accepts no liability for any decision made or action taken on the basis of the calculator results.

14. Monthly Smartphone Prize Draw

In addition to the quarterly cash prize draw described in Section 12, CHOPPERS OÜ ("Organiser") operates a recurring monthly prize draw in which one (1) new flagship smartphone (brand and model, for example Apple, Samsung or another comparable manufacturer, chosen at the Organiser's sole discretion) is awarded each calendar month.

Eligibility. Open to registered users aged 18 or over who, at the moment the draw is made, have at least one (1) active, published listing on choppers24.com that complies with these Terms. Employees of the Organiser, its affiliates and their immediate family members are excluded. One entry per user per monthly draw regardless of the number of listings held. Listings that are removed, expired, fraudulent, duplicated or in breach of these Terms confer no entry.
Selection of the winner. The winner is drawn at random from all eligible entries within the first seven (7) days of the following calendar month. The draw is final and no correspondence will be entered into. The winner is notified via the email address or in-app messaging associated with their account and must respond within fourteen (14) days; failing that, the prize is forfeited and a replacement winner may be drawn.
Prize details. The prize consists of one new flagship smartphone; brand, model, colour, storage capacity and place/method of delivery are determined solely by the Organiser. The prize is personal, non-transferable and cannot be resold or exchanged.
No cash alternative. No cash or other substitute will be offered. The Organiser reserves the right to substitute a prize of equal or greater value where the stated model is unavailable.
Taxes and duties. Any income tax, import duty, customs charge or other levy arising from receipt of the prize is the sole responsibility of the winner in their country of residence. The Organiser will report the award to the competent authorities where required by law.
Data processing. For the purpose of running this recurring draw the Organiser processes the entrant's account identifier, name, email address, phone number and listing data on the legal basis of legitimate interest / performance of these Terms (Art. 6(1)(b) and (f) GDPR). Winners' first name and city may be published for transparency; personal data of non-winners is not retained beyond the draw month. See the Privacy Policy for rights of access, rectification and erasure.
Amendment or cancellation. The Organiser may amend, suspend or cancel any monthly draw at any time where required by law or due to circumstances beyond its reasonable control. Estonian law applies; the courts of Estonia have exclusive jurisdiction.
